Copyright policy

How to reach our designated agent, and what happens next.

Latently is a reading tool for research papers. The papers themselves belong to their authors and rights holders — we reformat them for comfortable reading, always link to the original, and serve openly-licensed papers with attribution. When a user adds a paper or uploads their own file, that happens at the user's request, not ours.

If you believe material available through Latently infringes your copyright, this page tells you how to reach us and what happens next. We respond to notices under the US Digital Millennium Copyright Act (DMCA) and the corresponding provisions of Singapore's Copyright Act 2021.

Filing a takedown notice

Email dmca@latently.app with all of the following (17 U.S.C. §512(c)(3)):

  1. Your physical or electronic signature (or that of someone authorized to act for the rights holder).
  2. Identification of the copyrighted work you believe is infringed.
  3. Identification of the material you want removed, with enough information for us to locate it — the Latently paper link or title is ideal.
  4. Your contact information: name, address, telephone number, and email.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Incomplete notices may not be actionable, but we will tell you what's missing rather than ignore you.

A note before you file: under §512(f), knowingly materially misrepresenting that material is infringing can make you liable for damages. Also worth knowing: much of what Latently serves is published under Creative Commons licenses that expressly permit redistribution with attribution — check the paper's license line first.

What we do with a valid notice

  • We remove or disable access to the identified material expeditiously.
  • If the material was added or uploaded by a user, we notify that user and provide them a copy of the notice.
  • We record the notice for our repeat-infringer policy (see our Terms of Service).

Counter-notices

If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notice to dmca@latently.app containing (17 U.S.C. §512(g)(3)):

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for your district (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who filed the original notice or their agent.

On receiving a valid counter-notice we forward it to the original claimant. Unless they notify us within 10–14 business days that they have filed a court action, we may restore the material.

Repeat infringers

We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. The full policy is in our Terms of Service.
